Use of Fotoyz

Fotoyz can generate images ("Generations") based on text inputs ("Prompts") and a set of images you upload ("Training Set").

Age Requirements

By accessing the services, you confirm that you are at least 16 years old and meet the minimum digital consent age in your country. If you are not old enough to agree to these terms in your country, a parent or guardian must accept them on your behalf. If you are a parent or legal guardian allowing a minor to use the services, you agree to these terms and take responsibility for their activities. No guarantee is provided regarding the appropriateness of the Generations.

Use of Generated Images

As long as you comply with these terms and our Content Policy, you may use the Generations for any legal purpose, including commercial use. This means you can sell rights to the Generations you create, incorporate them into books, websites, presentations, and commercialize them in other ways.

Prompt Guidelines

Fotoyz should not be used for:

• NSFW, obscene, or sexually explicit material
• Hateful or violent imagery, such as antisemitic symbols, racist caricatures, or misogynistic propaganda
• Prompts and uploads should avoid copyrighted or trademarked material.

Credit Purchases

You may purchase credits to create additional training, subject to our Payment Terms. Credits must be used within one year from the date of purchase, or they will expire. We may change our pricing at any time by updating our pricing page.

Prohibited Use

You must comply with our Content Policy and must not use Fotoyz in a way that harms others or infringes on their rights. For example, you should not submit uploads or prompts that include copyrighted content, unauthorized images of individuals, or prompts designed to generate harmful or illegal images. We may delete prompts, uploads, or suspend/ban your account for any violation.

Ownership of Generations

To the extent permitted by law, and between you and Fotoyz, you own your Prompts, Uploads, and Generations. As long as you comply with these terms and our Content Policy, Fotoyz grants you exclusive rights to use these Generations and will not resell or claim copyright over them against you or your end users. However, if you violate our terms or Content Policy, you lose your rights to use the Generations. We will provide written notice and an opportunity to correct the violation unless it is clearly unlawful or abusive. You acknowledge that others may generate similar or identical images using their own Prompts, and your rights apply only to your specific Generations.

Storage Policy

Generated images, training images, and models will be automatically deleted 30 days after training completion. You can delete your fine-tuned model, training images, and generated images at any time.

No Warranty

We plan to continue improving Fotoyz, but we do not guarantee its functionality or suitability for any particular purpose. Your use of Fotoyz is at your own risk.

The service is provided "AS IS" and "AS AVAILABLE" without any warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or any warranties arising from usage.

Fotoyz does not warrant that a) the service will be uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the service is free from viruses or harmful components; or d) using the service will meet your requirements or expectations.

Limitation of Liability

Fotoyz shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages. In no event shall Fotoyz's total liability exceed the total amount you paid for the services.

Changes to Terms

Fotoyz may update these terms from time to time. We will post the updated terms on our website, and they will take effect upon posting. By continuing to use the services, you accept the new terms.
